Social work seminar: The importance of law and access to justice for disabled persons

Nicola Mackintosh QC (Hon) is a solicitor and sole practitioner of a small niche specialist legal firm representing disabled clients. She has brought many of the leading cases in the community care and healthcare field, as well as in the Court of Protection for mentally incapacitated clients. She is Co Chair of the Legal Aid Practitioners Group and sits on the Law Society's Council, Access to Justice Committee and Mental Health and Disability Committee. She campaigns and lobbies vigorously for the rights of disabled people to legal advice and representation, and against the recent restrictions to legal redress, including legal aid cuts and changes to judicial review. Earlier this year the Lord Chancellor, Chris Grayling, recommended that she be appointed Honorary Queen's Counsel in recognition of her work.

This seminar will consider the importance of legal rights and their enforcement in the community care and mental capacity field, and consider the implications of some of the recent changes to the legal aid and the justice system. It will illustrate, through case examples, how disability rights have to be practical and real to be of any effect, the sometimes unexpected outcomes of legal challenge and the constitutional imperative of upholding the rule of law for all, particularly those who are disadvantaged by disability.
