Summary

This module explores the legal protection given to intellectual property, and considers the particular types of such property such as copyright and patents. It puts this law into the increasingly influential international context and also draws on comparative study of the protection afforded in other jurisdictions. It enables you to pursue research in individual areas of intellectual property law.

Aims

  • to examine the different elements of UK intellectual property law
  • to consider the interaction between UK law in this area and the international context in which intellectual property is protected
  • to analyse the role of intellectual property law within a commercial context

Learning outcomes

On successful completion of the module, students will be able to:

  • explain the different approaches taken by different elements of intellectual property law
  • critically evaluate UK intellectual property law, as compared to the equivalent law in certain other jurisdictions
  • critically evaluate the international context of the legal protection of intellectual property
  • explain the role of intellectual property law in creating a framework for commerce
  • critically evaluate the role of intellectual property law in encouraging and protecting artistic and scientific endeavour 

Curriculum content

  • the definition and scope of the concept of intellectual property
  • the nature, exploitation and fair use of copyright
  • patents and the requirements a patentable product
  • the protection of design rights
  • trade marks and the interaction with the tort of passing off
  • the legal protection of confidential information

Teaching and learning strategy

The module will be delivered in a form of the research-led teaching, which enables students to experience and get involved in the cutting-edge research. The module will be delivered through a combination of lectures and seminars which will introduce topics and guide students' independent reading and study. In addition seminars are designed to be a preparation for the exam and coursework i.e. the exam/coursework technique will be introduced. The technology enhanced learning will also be embedded in this module, such as discussion board, and social networking sites and the 3D virtual reality world.

Assessment strategy

The module will be assessed by coursework and examination, each of which will make up 50% of the overall assessment for the module. One piece of essay-based coursework will enable students to demonstrate an ability to undertake in-depth research and to critically evaluate an aspect of intellectual property law. The exam questions will enable students to demonstrate an understanding of the application of a range of intellectual property law through giving advice in respect of problem scenarios.
Students are given the opportunity to undertake a mock based on the previous year's exam paper and to work on the previous year's coursework.
